This Indenture made the Twenty first day of December in the yeare of our Lord god one thousand six hundred ninty Five Betweene Richard Spencer of Preston in the County of Lancaster Esquire on the one parte and William Farrington of Werden in the said County of Lancaster Esquire and Richard Hartley of Preston aforsaid in the County aforsaid gentleman upon the other parte Witnesseth that the said Richard Spencer for the payment and satisfaction of the just debts of him the said Richard Spencer mencioned [faded] hereunto anexed to the severall persons in the schedulle particularly named And also for and in consideracion of the sume of Tenne Shillings of Lawfull money of England to him the said Richard Spencer in hand paid before the ensealing and delivery of these presents by them the said William Farrington and Richard Hartley the receipte whereof hee doth herby acknowledge and therof and of every parte thereof doth accquit exonerate and discharge the said William Farrington and Richard Hartley the Executors Administrators and assigns and every of them forever by these presents As also for [faded] Their good causes and Valuble Consideracions him the said Richard Spencer herunto moveing hath demised granted sett and farme letten And by these presents doth demise grant sett and to farme lett unto them the said William Farrington and Richard Hartley their heirs administrators and Assigns All that Capital messuage mancion or Mannerhouse with appurtenances called the Hall of Martholme in the said County of Lancaster and the Demeisnes and Demeisne lands Mill and Kilne thereunto belonging and all and every the Closes Holmes and parcells of Land meadows and pasture therein herafter mencioned viz. The Great Barley Croft the litle Barley Croft the Northerne Croft the Southerne Croft the Burkfoote the Bibby Wall the little Ice the greate Ice the Close meadow the Wham Meadow the greate and little Coppy the Barne meadow the Stubbinge the high Furlong the Cliffe wood the Lyme trough the old Martholme the Kilne Crofte the Stoops Thunimoore Thunimore meadow The Wigan heys the Milne Thunimore the milme wood the Barton holme the milne Holmes the little milne holmes with the wast about the milne the Leeshes being sevrall Closes all occupied together. Conteynenig by estimacion Two hundred sixty acres by the same moore or less together with all and singular their and everey their appurtenances to the said Capital messuage manor or manorhouse belonging or in any wise appertyeneing or to or with the same usually occupyed or enjoyed And also one Annuity or yearely rent charge of five hundred punds of good and lawful money of England to be issuing payable and going out of and in all and every those the manners or Lordshipps Villages hamletts and ____ of Rufforth Harwood Longten Croston hesketh and Beconsall Tarleton cum Sollom Mawdsley nether Whittingham Wrigthington Shevington hawick homswood Totleworth lancaster preston Wiggan ormschurch Penwortham Much hoole Sutton Bretherton Eccelston juxta Croston Bispham Newbrough in lathom parrbould Salmsbury newton cum Scales Baroon in Downholland Bickerstaffe Winstanley Scarisbrick and North meales and in every or any of them or elsewhere in the said County of lancaster martholme only excepted with their and every of their appurtences and out of and in every parte and parcell therof payable yearly in and upon the feast days of St. john the Baptist and the nativity of our Lord and Saviour Jesus Christ by even and equal porcions and also the sume of Twenty pounds ninne pene to be issuinge out of the premisses aforsaid so often as it shall happen the said Annuity or yearely rent charge of Five hundred pounds or any part therof shall be behind or unpaid by the space of Twenty days next after any the days of payment upon which the same ought to be paid as aforsaid And also all that Capitall messuage and tenement in Ribleton and Brocholes in the said County of Lancaster heretofore puchased by Thomas Hesketh Esq. deceased of and from Richard Farrington gentlemen deceased together with all and every the Barnes Stables Outhousing orchards gardens lands and tenements meadows pastures and hereditaments whatsoever which weare purchased from the said Richard Farrington as aforsaid situate lyeing and being in Ribleton and Brockholes aforsaid in the said County of lancaster or in either of them with their and every of their appurtences And also all those the mannors and lordshipps Capitall messuages Mancion or Mannerhouses with the appurtenances in the aforsaid County of lancaster comonly called or known by the names of Mawdsley harwood Rufforth Martholme Houghwick and Beconsall with all the Demeisne lands therwith occupyed and to the same beloninge or apperteyneing with all and singular messuage Cottages houses edifices buildings barnes Stables Dovehouses orchards gardens lands tenements meadows pastures leasures Woods and underwoods heaths Turbaries Waste Comens moores marches Watters Wattercourses Streames Milnes Milne Dams Pooles Watter milnes and windmilnes Fishings Royaltys Swannaries Swann markes Games of Swanns Improvements Inclosures and wast ground soake of Milnes Suite of Court Services customes thoes wards Marriages Escheates Releifses Fines harriotts Amerciaments Courts Barron Courts Leete and View of Frankpledge Priviledges Jurisdicions Perquisits and profitts of Courts Goods and Chattells of Felons Fugitives Felons of themselves and Outlawed persons Deedlands Waifes Estrays Estovers and Comon of Estover Faires marketts Tolls Rights Jurisdicions Franchises priveledges Liberties profits Comodities advantages Enrolments and hereditaments whatsoever with all and singular their appurtences of what kind nature quality soever they be situate lyeing and being within the precincts Hamletts folds or Territories of Mawdsley harwood Rufforth martholme houghwick Hesketh and Beconsall aforsaid or to or with the same used occupied or enjoyed or accepted reputed deemed taken or known to be part parcell or member therof and the Revercion and Revercions Remainder and Remainders of the said Manners and premises and every parte and parcell of the same And all rents and yearely sume and sumes of money reserved or to become due and payable in by or upon any Demises Leases or grants made of the premises or any parte or parcell therof And all the whole estate right tytle interest clame and demand whatsoever of himself the said Richard spencer of in and unto the same All and every which before mentioned Capitall messuagge mansion or mannerhouse called Martholme and the Demeisnes Mill kilne and severall Closes Closures and parcells of land before particularly mentioned and the said Rent charge or Annuity of Two hundred pounds per Annum and the said nomine pene of Twenty pounds together with the said Capital Messuage tenent lands and premises in Ribbleton and Brockholls aforsaid and also the before mentioned mannors and Lordshipps Caitall messuage mansion or mannerhouses called or known by the names of Mawdsley Harwood Rufforth marholme houghwick hesketh and Becconsall with the Demeisne lands premises and appurtenences herin before mencioned were hertofore by severall Conveyances duely exercised setled by Thomas Hesketh Esq. Deceased upon Sidney his wife and now wife of the said Richard Spencer in joynture or otherwise During her life or for some greate number of yeares yet in being Determinable upon her death as in and by the said conveyances relation being therunto had may appear To have and to hold the said Capitall messuage manor and mannerhouse called martholme and the Demeisne lands milne Kilne and the said severall closes closures and parcells of land before mentioned And also the said Annuity or yearely rent charge of Two hundred pounds and the said nomine pene of Twenty pounds and the said Capital Messuage tenent lands and premises in ribbleton and Brockholes aforsaid and also all and every the said mannors and lordshipps Capital messuages mansion or mannerhouses Called mawdesley Harwood Rufforth martholme Houghwick hesketh and Beconsall with the Demeisne Lands hereditaments and premises therunto belonging unto them the said william Farrington and Richard hartley their Executors and Administrators from the day of the Date herof for and during the terme and unto the full end and terme of fourscore and ninteene yeares thence next ensueing and fully to be Compleated if both the said Richard Spencer and the said Sidney his wife so long live neverthelesse to and for the severall uses and under and upon the severall trusts herin herafter in these Rents mencioned and expressed and to and for no other use intent or purpose whatsover That is to say that they the said William Farrington and Richard hartley and the survivors of them his Executors Administrators and Assigns shall out of the rents issues and profitts of all and every the before mencioned manner house called Martholme and the said Demeisne Lands Milne Kilne annunity of Five hundred pounds per Annum aforsaid And also out of the before mencioned Capital messuage tenements ands and premises in Ribbleton and Brockholes aforsaid and the said manners mannorhouse Demeisne lands and premises raise receive and Reimburse themselves all and every such sume and summes of money expences and Disbursements as they either of them their or either of their Executor Administrators Assigns shall lay Downe expend or be exposed unto for or by reason of their inform——– in the execution of this truste contained in these presents and perticularly such sume and sumes of money rents charges and expences and Disbursements as they the said William Farrington and Richard Hartlye and they survivor of them his Executors Administrators and Assigns shall expend Disburse or lay downe in any such or suites at Lawe or in Equity touching their being concerned or actinge in the Trusts concerned in these presents And upon further trust and speciall confidence that they the said William Farrington and Richard Hartley and the survivor of them his Executors Administrators and Assignes shall forth of all the remainder of the Annuall rents issues and profitts of all and every the said premises raise levey receive and take the several sums of meoney mentioned in the said Schedule herunto annexed together with the legall interest already due and to become due for the same And that they satifye and pay the same unto the severall and respective Creditors in the said Schedule perticularly named in such order and priority as in the same Schedule is in that behalfe sett downe and expressed and from and after the payment and satisfaction of the said Debts and the interest charges That they the said William Farrington and Richard Hartley and the survivor of them his Executors Administrators and Assignes shall raise satisfye and pay all the rest residue and Remainder of the said Annuall rents issues and profitts of all and every the before mencioned Mannorhouse caled Martholme and the said Demeisnes Miln and Kilne Annuity or Rentcharge of Two hundred pounds per Annum and also the Capital messuage and tenement of Ribbleton and Brockhole aforsaid and the before mencioned Mannors Mannor houses Demeisne Lands and premises unto the said Richard Spencer for and during all the rest residue and remainder fo the said terme of Fourscore and nineteen yeares Determinable as aforsaid which shall be then to come and unexpired and to and for no other use intent or purpose whatsoever
